Terms of Use

By downloading or using the GrowKit app, these terms will automatically apply to you. Please make sure that you read them carefully before using the app. If you do not agree with these terms, please do not use GrowKit.

GrowKit is a platform that helps farmers, livestock owners, buyers, and rural sellers discover and connect with each other.

Using GrowKit

You must be at least 18 years old and legally capable of entering into an agreement under applicable Indian law.

You must use a mobile number that you control when creating or accessing your GrowKit account. You are responsible for keeping your phone, OTP, and account secure. Please do not share your OTP with anyone.

You are responsible for the activity carried out through your account and for providing accurate information when creating your profile or posting a listing.

About the GrowKit App

GrowKit allows users to list and discover farm animals, express interest, make offers, call or share listings, measure land, check weather and mandi prices, and use other features made available through the app.

GrowKit may also allow you to describe an animal problem by typing or using speech and request assistance from GrowKit Doctor. Where available, GrowKit Doctor may connect you with an assigned veterinary professional for a call or visit. A visit is subject to availability, location, and other practical conditions, and GrowKit does not guarantee that a veterinary professional will attend every requested visit.

GrowKit is a platform. We are not the buyer or seller of animals or goods listed by users, and we do not take possession of animals or goods listed through the app.

Intellectual Property

You are not allowed to copy, modify, reproduce, distribute, reverse engineer, extract the source code of, or create derivative versions of the GrowKit app or any part of it.

You must not misuse the GrowKit name, logo, trademarks, designs, software, or other intellectual property.

The GrowKit app, its software, design, trademarks, and related intellectual property rights belong to their respective owners, except for content that is owned by users or third parties.

GrowKit may make changes to the app, add new features, remove features, or change the availability of certain services from time to time.

User Listings and Content

Listings, photographs, descriptions, offers, profile information, GrowKit Doctor problem descriptions, and visit photographs may be provided by users. Users are responsible for the content they upload to GrowKit.

When using GrowKit, you agree that you will:

• Only list animals or goods that you have the right to sell.
• Provide accurate and genuine information about your listings.
• Use photographs that represent the actual animal or goods being listed.
• Not post illegal goods, stolen property, scams, or fraudulent listings.
• Not post hateful, sexually explicit, violent, abusive, or harassing content.
• Not share another person's personal information or photographs without appropriate permission.
• Not spam, scam, or deliberately mislead other users.
• Not misuse the reporting or blocking features.

If you see inappropriate content or behaviour, you can use the Report option on a listing and the Block option on a user.

We may hide or remove content, restrict features, suspend an account, or terminate an account where we believe these terms, applicable law, or the safety of users may be at risk.

Deals Between Users

GrowKit provides a platform for buyers and sellers to connect. Any transaction between users is directly between the buyer and seller.

Price, payment, inspection, transportation, delivery, ownership documents, animal condition, health information, and veterinary checks are the responsibility of the buyer and seller.

GrowKit does not hold or escrow money for transactions between users and does not guarantee that a buyer or seller will complete a transaction.

You should independently inspect livestock, ownership documents, health information, and other relevant details before making a payment or completing a transaction.

GrowKit Doctor

GrowKit may allow you to describe an animal or farm-related problem by typing or using speech and request assistance from GrowKit Doctor.

Where available, GrowKit may connect you with an assigned veterinary professional for a call or visit. The availability of a veterinary professional may depend on your location and other circumstances.

GrowKit does not guarantee the availability or attendance of a veterinary professional. Any veterinary advice, diagnosis, treatment, or professional service provided by a veterinary professional is their responsibility.

GrowKit Premium

GrowKit may offer Premium or other paid features. The features and applicable fees will be shown in the app before you make a payment.

Premium may provide access to additional features, such as additional listing information or the ability to contact sellers, depending on the features available in the app.

Premium does not guarantee a sale, buyer, seller response, animal availability, or any particular listing position or result.

If a payment is processed through Google Play or another payment provider, the payment, refund, and other applicable rules of that provider may also apply.

GrowKit may change, add, or remove Premium features from time to time.

Personal Data and Security

GrowKit stores and processes personal information that you provide to us in order to provide and improve our services. How we collect and use personal information is explained in our Privacy Policy.

Some features of GrowKit may require access to location, camera, photos, microphone, nearby devices, or notifications. These permissions may be optional, although certain features may not work without the relevant permission.

If you use the microphone to describe an animal problem, your speech may be converted into text. We do not retain the audio recording after processing.

You are responsible for keeping your device and access to GrowKit secure. We recommend that you do not jailbreak or root your device, as doing so may compromise your device's security and may cause GrowKit to stop working correctly.

Internet and Mobile Data

Certain features of GrowKit require an active internet connection. The connection may be provided through Wi-Fi or your mobile network.

GrowKit cannot take responsibility for the app not working correctly if you do not have an internet connection, have insufficient mobile data, or experience network problems.

If you use GrowKit through a mobile network, the terms of your mobile network provider will continue to apply. You may be charged by your mobile provider for mobile data, SMS, roaming, or other network-related services.

You are responsible for any such charges, including roaming charges when using the app outside your home territory.

You are also responsible for ensuring that your device remains sufficiently charged and operational when using GrowKit.

Third-Party Services

GrowKit may use third-party services to provide certain features of the app, including services for hosting, SMS, maps, weather, speech-to-text, analytics, crash reporting, payments, and other technical services.

These third-party services may have their own terms and conditions and privacy policies. Your use of those services may therefore be subject to their applicable terms.

Examples of third-party services used by the app may include:

• Google Play Services
• Google Analytics for Firebase
• Firebase Crashlytics
• Google Maps and related mapping services
• Other service providers required to operate GrowKit

Accuracy and Availability of Information

We try to keep the information available through GrowKit useful and accurate. However, some information is provided by users or third-party services and may be incomplete, delayed, inaccurate, or unavailable.

This may include livestock listings, prices, mandi prices, weather information, maps, and other information provided through the app.

You should not rely solely on information provided through GrowKit when making important purchasing, veterinary, financial, or other decisions.

GrowKit does not guarantee that the app or information provided through it will always be accurate, complete, current, available, or suitable for a particular purpose, to the fullest extent permitted by applicable law.

User Content Licence

You retain ownership of photographs, descriptions, listing information, and other content that you upload to GrowKit.

By uploading content to GrowKit, you grant GrowKit a non-exclusive, worldwide licence to host, store, display, reproduce, and share that content as reasonably necessary to operate and provide GrowKit's services.

This may include displaying listings to other users, sending listing-related notifications, enabling sharing features, and providing GrowKit Doctor services where relevant.

You must have the necessary rights and permissions to upload any content that you provide.

App Updates and Changes

At some point, we may wish to update the app. Updates may include new features, improvements, security updates, bug fixes, or changes to existing functionality.

The requirements for using GrowKit may also change as Android and other supporting technologies are updated. You may need to download updates if you want to continue using certain features of the app.

GrowKit does not promise that it will always update the app so that it remains compatible with every device or version of Android.

We may also stop providing the app or any part of the service where reasonably necessary. If the service is terminated, the rights and licences granted to you under these terms will end and you should stop using the app and delete it from your device where applicable.

Limitation of Responsibility

Neither GrowKit nor third parties providing services through the app provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered through GrowKit for any particular purpose.

You acknowledge that information provided through the app may contain inaccuracies or errors and that some services depend on third-party providers.

To the fullest extent permitted by applicable law, GrowKit will not be responsible for losses arising from transactions between users, user-provided information, third-party services, network failures, or reliance on inaccurate, incomplete, delayed, or unavailable information.

Nothing in these Terms of Use is intended to limit any rights or protections that cannot legally be excluded under applicable Indian law.

Termination

You may stop using GrowKit at any time.

To delete your GrowKit account and personal data, use the in-app Help or Support section and provide the mobile number associated with your account.

We may suspend or terminate your account if you violate these terms, misuse the service, harm or attempt to harm other users, engage in fraudulent activity, or create a legal, security, or safety risk.

Changes to These Terms of Use

We may update our Terms of Use from time to time. You are therefore advised to review this page periodically for any changes.

We will update the "Last updated" date at the top of this page when changes are made. Where appropriate, we may also notify you through the app.

Your continued use of GrowKit after the updated terms are posted means that you accept the updated Terms of Use.

Governing Law

These Terms of Use are governed by the laws of India.

Nothing in these terms limits any non-waivable consumer rights or protections available to you under applicable Indian law.
